The Terms of Service is the translation of those in Japanese.
The Japanese Version of these TOS is the authentic copy and should be given the priority over other language versions.

1. Terms of Service

• The contents of Terms of Service on our website in English and in Chinese (hereinafter called “TOS”) will be applied to international customers (both Japanese and non-Japanese). To residents in Japan (both Japanese and non-Japanese), Membership Contract on our website in Japanese will be applied.
• TOS is applied to users of the shopping site operating by Amazing Value Corporation (hereinafter called “AVC”).
• Users of the shopping site by AVC (hereinafter called “AVC Site”) are considered to agree with being subject to the TOS.

2. Amendment of TOS

• AVC reserves the right without prior notice or agreement with users to change, amend or modify TOS.
• Changed, amended or modified TOS become effective at the time when they are uploaded and updated on AVC Site.

3. Stop or interruption of the Services

• AVC reserves the right at any time and from time to time without prior notice or agreement with users to change, add, modify or discontinue a part or all of the services of AVC Site.
• AVC reserves the right without prior notice or agreement with users to stop or interrupt the services on AVC Site to do maintenance check.
• AVC shall not liable to users whatsoever for any loss or damage resulting from unavailability of AVC site.

4. Transactions

• Users are not allowed to do the following acts :
  
  • inappropriate use of AVC Site
  • doing something that annoy other users
  • obstructing AVC businesses
  • infringement of trademark, copyright or privacy or acts lead to such situation may arise
  • fraudulent use of credit cards
  • illegal use of other users’ personal information
  • other acts that AVC deems inappropriate
• AVC shall have the right to limit or refuse transactions or cancel or terminate contracts under the following circumstances.
  
  • orders against the prohibited acts set forth in the 1 clause of Article 4.
  • delay or failure of performance of one’s payment obligations
  • (At payment by credit card,) failure to compete credit card transaction
  • (At payment by credit card,) user requests delivery to other address than registered address of the cardholder.
  • no response to our inquiry from AVC regarding purchase orders
  • delivery to the region that AVC restricts shipments
  • orders of prohibited imports by the country of the user
  • orders of not in-stock item and further delivery schedule is not fixed
  • AVC receives orders more than quantity limit (available quantity) of limited items etc.
  • AVC deems to have trouble to make normal transactions due to repeated return or exchange
  • violation of this TOS or shopping guidelines
  • other acts that AVC deems it inappropriate as user
• AVC may hold shipment until it becomes clear the situation listed in the previous clause.
 
• In case of straps of crocodile leather and etc, subject to CITES listed species, AVC will not ship it out. Users need to have one at users’ cost as substitution in their own country.
 
• AVC shall not liable to users whatsoever for any loss or damage resulting from AVC take an action as in the 3 & 4 clause of Article 4.
 
• Shipping charge and insurance will be charged to users.
  
  • AVC grants user’s wish and makes a final decision on shipment method at the sole discretion of AVC.
  • Shipping charge and insurance will be invoiced to users together with the amount of the purchased item.

5. After-sales service

• AVC provides users after-sales service for items purchased from AVC. Please note, however, that :
  
  • in case of unavailability of parts, your watches may be sent to a distributor or to a manufacturer in Switzerland.
    Please note that, in such case, it will take much longer for delivery.
  • for antiques or discontinued models, it may be impossible to repair even at its manufacturers. In such case,
    AVC may return your watch without repair.
  • in case that the item have been worked after purchase from AVC, AVC unable to provide after-sales service for such items.
  • AVC will not accept any claim after repair. To avoid further trouble, such as scratches and etc.,
    AVC checks items in detail upon receipt and makes condition report for each item.
    If you request such condition report in advance, AVC will send you copy of such report.
  • AVC basically repairs a watch in our service department, but depending on its condition,
    it may be repaired at manufacturer outside Japan at the sole discretion of AVC.
  • in case of unavailability of parts even at manufacturers due to expiration of storage period of parts,
    AVC are unable to repair your watch and return it to you unrepaired.
  • delivery schedule is varied according to repair and condition of each watch,
    but basically, it will take about 4 weeks after AVC receives your watch.
    In case the watch need to be sent to manufacturer outside Japan, it may take between 3 months at least and about a year at maximum.
    If it may take more time to repair, AVC will inform you in advance of detailed condition and updated delivery schedule.
   
• Repair standards
  
  • QC after repair
    AVC makes QC according to our standards and uses the following as a target rate for mechanical watches :
    between +1s/day and +20s/day (same as chronometer standards of ROLEX etc.)
    Please note that this rate is that on winding machine and it may vary in individuals when it is actually worn.
    If you have any request on accuracy, please let us know in advance the results after you use your watch for a week as usual.
    AVC will make every effort to adjust accuracy to meet your request.
  • brand-name parts
    If brand-name parts are no longer available, some parts may be made or ordered to make at our side.
    In such case, AVC will contact you in advance to obtain your prior consent.
  • component failure
    If AVC finds component failure that require additional fee in the course of repair, AVC will soon contact with you to ask you if you prefer proceeding or stopping the repair.
    
  • polish
    AVC makes every effort to polish your watch as the same level as its manufacturer. If you find some difference with your watch, AVC is unable to meet a claim for such differences.
    Polishing may make engraved mark lighter, so that AVC may not polish watches at the sole discretion of AVC depending on its condition. For instance, ink-in bezel, caseback with lightly engraved mark, part that even manufacturer do not polish - like ROLEX bezel.
  • dents
    To polish big dents, it may change greatly in shape of the part. AVC places more emphasis on shape of watches and don’t try hard to polish big dents at the sole discretion of AVC.
  • cancellation
    AVC is not able to accept cancellation once you accept our estimates of repair fee.
    AVC is unable to guarantee condition of the watch if you request cancellation in such case and AVC will charge you 100% of our estimates as cancellation fee.
    In case the watch need to be sent to manufacturer outside Japan, AVC inform you approximate estimates before AVC arrange shipment to abroad. Once you accept the amount of approximate estimate, AVC sends the watch to manufacturer. AVC is unable to accept cancellation if exact estimate is within the approximate estimate. In such case, AVC will charge you 100% of our estimates as cancellation fee.
• Warranty
  
  • Warranty period for the item purchased on AVC site vary according to each watch.
    Please check this point when you purchase your watch.
  • Regarding in-warranty items of manufacturer, please contact with manufacturer or retailer directly.
    AVC shall be contact for the item purchased on AVC.
  • Warranty period for the item repaired by AVC vary according to each watch.
    Please check this point when your watch returned to you after repair.
  • In case of repeated repairs, unfortunately, AVC is unable to refund of the purchased amount of the watch. Even in such case, repair will be done at customer service department of AVC.
    Please note that you need to pay repair fee if you request repair at manufacturer.
• Payment of repair fee
  

  AVC will send you our invoice for repair fee as soon as repair is finished.
  Please arrange payment for the invoiced amount to our bank account within 3 business days upon receipt of our invoice. As soon as we confirmed your payment, we will send you back your watch within 3 business days. Please note that shipping and insurance will be borne by customers.

• Insurance
  
  • In case of unreturnable state
    Due to theft, missing during transport, damage beyond repair, including but not limited to, AVC guarantees appraisal value specified by AVC unless it is not covered by property insurance (such as war, act of God etc. )
  • In case of repairable state
    Due to breakage during repair or during transport, delivery schedule will be extended and AVC covers all additional charges for such repair. User need to cover first estimated amount only.
• Dispute about repairs
  
  • AVC makes repairs in good faith and fair manner. AVC is unable to satisfy
    claims such as the watch is replaced with fake product or its movement is replaced with fake during repair at AVC.
  • AVC will hold repaired watches for 6 months from the issuing date of AVC
    invoice for repair fee. In default of payment for 6 months, ownership of the repaired watch shall be transferred to AVC in offset its repair fee.
 

6. Copyright

• No one can use copyrighted works by AVC and intellectual property that AVC holds its rights to use without approval from AVC.
• Information from users shall be considered that AVC entitled to use such information. Please note that such information will be used for publication.

7. Handling of personal information

AVC shall handle personal information of AVC users appropriately based on privacy policy and handling of personal information of AVC users.

8. Governing law

These terms of service shall be governed by and construed in accordance with the law of Japan, except its choice of law rules.

9. Consultation and Jurisdiction

• In case that any issue arises between users and AVC, both parties shall settle it through consultation in good faith.
• If any issue which may arise between users and AVC, which may not be settled through consultation as on the preceding clause, both users and AVC agree that the Tokyo District Court shall have exclusive jurisdiction over any issue between users and AVC.

10. Handling of personal information

• Term “Personal Information”
  

  AVC shall place strict controls on the following information as “personal information of users” name, sex, address, birth date, email address, request and comments etc. required at order payment method, shipping address and purchased items etc. required in transactions

• Use of Personal Information
  

  AVC uses Personal Information to the extent for achievement of the following business operation and purposes:

  • operation
    mail order business operation
    nonstore buying and purchase
    after-sales service
  • purpose
    to deliver purchased items, reply to inquiries and provide after-sales service
    to bring favorable information for AVC customers
    to use as statistics data for marketing or improvement of our services
    to carry out a questionnaire survey for product planning or improvement of magazine contents
    
• Providing and entrustment of personal information
  

  AVC provides personal information to third parties only in the following cases :

  • upon obtaining the customer’s prior consent
  • AVC entrust handling of personal information to the extent for achievement of the purpose indicated to the customer to a company whose conservation and management structure of personal information deemed to reach a certain level. Contents of entrusted operation mean cooperative operation such as tie-up magazine company, encapsulated articles etc.
  • ordered to provide by decree
• Procedures of disclosure, correction and others of personal information
  

  If you requests disclosure of personal information of a customer oneself, correction of incorrect facts, notice of purposes, stop using and providing personal information to third parties, AVC will start working on a prompt action. Please do not hesitate to contact us.

• SSL and Cookie
  

  AVC website uses SSL encryption technology to keep users’ personal information secure. Users’ personal information including credit card number etc. is encrypted and sent to process communication under adequate security system AVC uses cookies for identification of users’ access. Cookies are parcels of text maintaining specific information about users in users’ computers.
